Regular Session 

February 9, 2010

Trustee Romano called the meeting to order at 5:26 p.m. Trustee Corey and Trustee Patterson was present. Also present was Interim Administrator Bill Becker, Fiscal Officer John Wahle and Law director Tom Swope.

Executive Session

A motion by Trustee Corey and second by Trustee Patterson (under authority of Ohio Revised Code Section 121.22 G) to enter executive session to consider the appointment, employment, dismissal, discipline, promotion, demotion or compensation of a public employee or official. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to return to regular session. Motion carried unanimously.

Trustee Romano gave the opening prayer.

Trustee Patterson led the Pledge of Allegiance.

Presentation

Ted Plattenburg, DHR, gave a report on filling the position of township administrator.

Fiscal Officer

John Wahle presented the agenda items.

A motion by Trustee Corey and second by Trustee Patterson to approve Purchase Orders #10-14114, 14116, 14123, 14125, 14129, 14156, 14169, 14174, 14175, 14176, 14183, 14185, 14189, 14199, 14209, 14211, 14212 and 14220. Motion carried unanimously.

A motion by Trustee Corey and second by Trustee Patterson to approve Resolution #2010-003 A Resolution Directing Payment of Township Expenses, Declaring an Emergency and Dispensing with the Second Reading. Motion carried unanimously.

Board Action – New Business

Public Works

Public Works Director Larry Weis presented the agenda items.

A motion by Trustee Corey and second by Trustee Patterson to approve Kris Blevins, Billy Highfill and Chip Cowan to purchase Pesticide Training Material and attend a one day training session on March 31, 2010 in Reynoldsburg OH at a cost per employee of $85 each for a total of $255. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to approve the purchase of a 2010 John Deere 6330 Tractor with Alamo 17' Mower and Arm at a state bid price of $66,931.34 including a trade-in. Motion carried unanimously.

A motion by Trustee Corey and second by Trustee Patterson to approve the purchase of a 2010 John Deere Gas Power Gator at a state bid price with trade-in for a total of $9,481.48. Motion carried unanimously.

Mr. Weis presented a Road Certification from the Warren County Engineer’s office for two of three trustees to sign certifying the roadways maintained by the township.

Parks

Bill Becker presented the agenda item.

A motion by Trustee Corey and second by Trustee Patterson to approve acceptance of the proposal from Architect Sales at a cost of $3,112 and authorize the township administrator/park director to sign all applicable documents and approve the proposal from the appropriate TIF fund. Motion carried unanimously.

Administration

The Board discussed a request from Mason/Deerfield Rotary for a representative to attend meetings. Fire Chief Chris Eisele gave an interest in representing the township at Rotary meetings.

A motion by Trustee Romano and second by Trustee Corey to not request a hearing on the application for a D1, D2 and D3 liquor license permit for Baiwei Restaurants, Inc. DBA Dao Modern Asian Cuisine, 5065 Deerfield Blvd. 45040. Motion carried unanimously.

Community Development Director Lois McKnight presented the agenda item.

A motion by Trustee Corey and second by Trustee Patterson to approve Resolution 2010-04 A Resolution Unanimously Authorizing the Amendment to a Real Estate Purchase Agreement for the Sale of Certain Real Property to HPA Development Group, Inc. Authorizing the Acting Township Administrator to Sign Addendum 2 to the Contract for Real Estate Purchase, Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

Approval of Minutes

A motion by Trustee Patterson and second by Trustee Corey to approve the meeting minutes of January 26, 2010 Regular Session with a correction: line seven to read Faith Bible Church. Motion carried unanimously.

Consent Agenda

A motion by Trustee Romano and second by Trustee Patterson to approve Warrants #56270 through 56337. Motion carried unanimously.

Board Action – New Business (continued)

Fire Department

A motion by Trustee Romano and second by Trustee Patterson to proceed with plans to place the levy on the May ballot and adopt Resolution 2010-05 A Resolution Determining to Proceed to Levy a Tax in Excess of the Ten-Mill Limitation with the Township. Motion carried unanimously.

Executive Session

A motion by Trustee Corey and second by Trustee Patterson (under authority of Ohio Revised Code Section 121.22 G) to enter executive session to consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee or official; to consider the purchase of property for public purposes, or for the sale of property; conference with an attorney for the public body concerning disputes involving the public body that are the subject of pending or imminent court action. Motion carried unanimously.
