Regular Meeting

July 1, 2008

Trustee Corey called the meeting to order at 5:15 p.m. Trustee Patterson was present. Also present was Dan Evers Administrator and Tom Swope, Law Director. Trustee Romano and John Wahle, Fiscal Officer, were absent with prior notice.

 

Trustee Patterson led the Pledge of Allegiance.

 

Executive Session

A motion by Trustee Corey and second by Trustee Patterson to enter executive session to discuss land acquisition. Motion carried.

 

A motion by Trustee Corey and second by Trustee Patterson to return to regular session. Motion carried.

 

Presentations

Rachel Hutzel, Warren County Prosecutor, presented her 2007 Annual Report.

 

A motion by Trustee Corey and second by Trustee Patterson to appoint Peggy Monjar to take minutes. Motion carried.

 

Fran Klatte, Public Relations Director, and Acting Fire Chief Chris Eisele introduced the Deerfield Fire Rescue new logo for all uniforms and vehicles. The Mass Casualty Unit was parked outside the meeting room to demonstrate the professional look of the new logo.

 

The Board recognized the Kings Character Award winners: Erin Leo, Michael Morgan and Emily Leary. Erin Leo was present to receive a certificate.

Fiscal Officer

A motion by Trustee Patterson and second by Trustee Corey to approve Purchase Orders 08-11226 through 08-11229 and Warrants #52964 through 52973. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to approve the TIF payment of $2,670 to Plattenburg and Associates, Inc. from the General Reserve Fund. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to approve Resolution 2008-054 A Resolution to Adopt the 2009 Tax Budget and to Submit the Annual Budget for the Year Commencing January 1, 2009 for Consideration of the County Budget Commission Pursuant to Section 5705.30 of the Revised Code. Motion carried.

Community Development

Ronnie Caldwell, Code Enforcement Officer, presented the following public nuisance agenda items.

 

A motion by Trustee Patterson and second by Trustee Corey to declare the property at 7685 Kings Mills Road, Maineville, OH 45039 a public nuisance pursuant to ORC 505.87 and adopt Resolution 2008-55 A Resolution Providing for and Authorizing the Removal of the High Grass and Weeds Located on 7685 Kings Mills Road, Dispensing with the Second Reading and Declaring an Emergency. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to declare the property at 7655 Kings Mills Road, Maineville, OH 45039 a public nuisance pursuant to ORC 505.87 and adopt Resolution 2008-56 A Resolution Providing for and Authorizing the removal of the high grass and weeds located on 7655 Kings Mills Road, Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

 

A motion by Trustee Patterson and second by Trustee Corey to declare the property at 2398 Lilac Road, Loveland, OH 45140 a public nuisance pursuant to ORC 505.87 and adopt Resolution 2008-57 A Resolution Providing for and Authorizing the Removal of the High Grass and Weeds Located on 2398 Lilac Road, Dispensing with the Second Reading and Declaring an Emergency. Motion carried.

 

Lois McKnight, Community Development Director, presented Case 2008-200 Modifications to Approved Stage 3 Plan for Lot#5 of Shoppes of Deerfield North.

 

A motion by Trustee Patterson and second by Trustee Corey to approve the modification to the Stage 3 Plan and permit the placement of one ground sign with the conditions stipulated in the staff report. Motion carried.

 

Lois McKnight presented Case 2007-196 Stage 2 Preliminary Site Plan Review for Kings Mills Restaurants and Retail.

 

Trustee Corey opened the public portion of the hearing.

Mary Altenbach, representing McDonald’s, spoke about the project.

Trustee Corey closed the public portion of the hearing.

A motion by Trustee Patterson and second by Trustee Corey, to approve Case 2007-196, Stage 2 Preliminary Site Plan Application for the Kings Mills Restaurants and Retail, subject to nineteen (19) conditions as recommended by the Zoning Commission, with a change to Condition 19 to read: “Applicant is granted partial approval of Stage 2, Preliminary Site Plan.  Final Stage 2 approval will be granted upon review and approval by the Board of Trustees of a design package for the entire development which includes details on design elements such as signage, landscaping, hardscaping, pedestrian points, and architectural theme.”

 

The motion was withdrawn by Trustee Patterson.

 

A motion by Trustee Patterson and second by Trustee Corey to  approve Case 2007-196, Stage 2 Preliminary Site Plan Application for the Kings Mills Restaurants and Retail, subject to nineteen (19) conditions as recommended by the Zoning Commission with a change to Condition 13 to read: “Sidewalks 10 feet in width shall be installed along the Kings Mills Road and Kings Island Drive frontages of the project” and a change to Condition 19 to read: “Applicant is granted partial approval of Stage 2, Preliminary Site Plan.  Final Stage 2 approval will be granted upon review and approval by the Board of Trustees of a design package for the entire development which includes details design elements such as signage, landscaping, hardscaping, pedestrian points, and architectural theme.” Motion carried.

 

Public Works

A motion by Trustee Patterson and second by Trustee Corey to accept for public maintenance the streets in the Greens at Crooked Tree, Sections 1 through 4. Motion carried.

 

Fire Department

Acting Fire Chief Chris Eisele presented the following agenda items.

 

A motion by Trustee Patterson and second by Trustee Corey to approve Resolution 2008-58 A Resolution Accepting a Donation of Emergency Equipment from the Warren County Emergency Management Agency and Waiving a Second Reading. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to accept the proposal from R.E. Middleton Construction for a cost of $18,532 and authorize the Township Administrator to sign any applicable documents. Motion carried.

 

Administration

Dan Evers presented the following agenda items.

 

A motion by Trustee Patterson and second by Trustee Corey to approve the renewal of the OTARMA Insurance Package for $6,000,000 coverage at a cost of $91,340 and authorize the Township Administrator to execute all necessary documents necessary to effect the renewal. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to not request a hearing on the application to transfer D5 and D6 liquor permits for Shaber Inc. DBA O’Neal’s Tavern, 2910 W. US 22/3, Units 2-4, Maineville, 45039. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to not request a hearing on the application of a D1 liquor permit for National Amusements Inc. DBA Showcase Grill Kings Island, 5937 Kings Island Drive, First Floor Only, Mason 45040. Motion carried.

 

Approval of Minutes

A motion by Trustee Patterson and second by Trustee Corey to approve the meeting minutes of May 9, 2008 emergency meeting, May 22, 2008 work session, June 3, 2008 regular meeting, June 17, 2008 regular meeting and June 26, 2008 work session. Motion carried.

 

 

 

 

 

Consent Agenda

Human Resources

A motion by Trustee Patterson and second by Trustee Corey to approve the attendance of Captain Dan Seiller, Captain Dennis Waldbillig and Inspector Curt Frazee at the VFIS Drivers Training Program on July 26 and July 27, 2008 in Wilmington, OH at a cost not to exceed $775. Motion carried.

 

A motion by Trustee Patterson and second by Trustee Corey to approve the request to purchase an on-line subscription from the Nation Paramedic Institute for a period of one (1) year. Motion carried.
