CASE  #2006-398                      4486 Kings Water Drive, Kings Dodge, Stage 2 Site Plan Review

Staff Report                             Hayfaa Wadih explained the location of the Kings Dodge on 6.65 acres.  The application was for a building addition to the existing auto sales service.  The access to the property will not change.  She explained the interior circulation and parking spaces.  The plan proposed 4 signs.  She said the staff recommended approval including 19 conditions.  She asked the board for questions.  There was none.

Proponent                                Tom Vanden Bosch, McGill Smith Punsheon, 5700 Park 42 Drive, Cinti., 45241, said he was representing the applicant.  He asked about Condition #12 and if that was a new one.  Lois McKnight  said they are just asking for some plants other than grass.  Mr. Vanden Bosch asked for something different in the plan, a change to the site plan they originally submitted to us.  Mr. Vanden Bosch said the change from the original plans would be to relocate that proposed green space from northeast portion of site to west side, maintaining 10 feet buffer on the east and 21.6% green space overall.   Ms. McKnight asked if there was an issue in that location about providing open space between this property and the adjoining property.  Robert Reichert, 9500 Kings Automall Drive, explained the change to move the green space.  Matt Evans asked if there would be a buffer area between the two parking areas of the Lexis and the Dodge.  Mr. Vanden Bosch said yes.  Matt Evans asked how tall is the existing vegetation there.  Mr. Vanden Bosch said that area is old trees which are 60-70 feet. tall.  John Richardson asked Lois what she meant by just asking for plants other than grass.  Lois said that  condition would be straight out of our code.  Lois said the goal of Condition 12 is not to increase the width of the green space but to put something in there other than grass.  Robert Reichert, 9500 Kings Automall Drive, said the arrangement and consolidation of two showrooms is because they are trying to comply with suggestions from the manufacturer.  John Richardson asked Lois if Condition #18 regarding a $600 fee to be paid to Warren County Soil & Water Conservation District is a new one and are there inspections?  Lois said they are involved with discussions with Warren County Conservation and are hoping to have more inspections during the construction process.

  1. Adherence with all prior Warren County and Deerfield Township Resolutions applicable to Waterstone, except as herein modified.
  1. Approval of the proposed land use at a location outside the area originally anticipated for activities associated with the Kings Automall, by the Deerfield Township Trustees.
  1. Prior to final site plan approval, written approval of the site access and interior circulation by the Warren County Engineer, in conjunction with the Deerfield Township Fire Rescue, is required.
  1. A permit is required from the Ohio Department of Transportation prior to performing any work within the Interstate 71 right-of-way, as applicable.
  1. Prior to final site plan approval, a letter of approval of stormwater management and compliance with the Rules and Regulations for the Design of Stormwater Management Systems, as determined by the Warren County Engineer, is required.  Also, due to the large percentage of the site with impervious surfaces, post construction stormwater quality must be addressed. Conversion of a dry/detention stormwater basin to a wet/retention basin is subject to approval of necessary drainage calculations.
  1. Compliance with the Ohio Environmental Protection Agency (OEPA), National Pollutant Discharge Elimination Systems (NPDES) permit for stormwater discharges associated with construction
  1. Compliance with the Warren County Erosion and Sediment Control Regulations, as determined by the Warren County Soil & Water Conservation District.
  1. The developer shall expand and/or upgrade the water system, water treatment and storage facilities, sanitary sewers and wastewater treatment facilities necessary to serve the development, as determined by the Warren County Sanitary Engineer.
  1. Vehicle parking and display shall be permitted on the pavement surface and no parking or display shall be allowed on any grass areas.
  1. Wall and ground mounted sign details including height, area, and materials shall be submitted prior to Stage 3 approval and shall comply with the previously approved PUD Regulations.  Total sign face area shall not exceed 213 square feet excluding the “Service” directional sign.
  1. Final detailed landscaping plan is required for Stage 3 submittal that shows bufferyard and landscaping including species and size, in compliance with Chapter 21 of Deerfield Township Zoning Resolution. All service structures, including loading dock and dumpster, shall be completely screened from the right of way of Interstate-71.
  1. A buffer of trees, shrubs, planting beds, and/or perennials in a motif is required along Kings Water Drive in accordance with Deerfield Township Zoning Resolution, Section 21.10.
  1. Within the green space area at the north east portion of the development, no clearing beyond 10 feet from the proposed edge of the pavement is permitted.
  1. All outdoor light fixtures shall be down directional. Building mounted lighting fixtures shall not exceed 15 feet in height and free-standing lighting fixtures shall not exceed 24 feet in height with no-lenses protruding below the housing. All outdoor lighting illumination shall not create a spot glare nuisance to residence in the vicinity north and east and motorists on I-71. 
  1. Detailed pedestrian plan is required for Stage 3 submittal.
  1. All roof-top mechanicals and light wells shall be screened from public view by parapet walls and from right-of-way of Interstate-71.
  1. Prior to the issuance of zoning permit, applicant shall secure and submit a letter of approval from Deerfield Township Fire Rescue.
  1. Filing fees of $600.00 ($100/disturbed acre) for this project in addition to all other applicable fees for erosion and sediment control is requested by Warren County Soil & Water Conservation district to be received before a building permit can be issued according to the county’s erosion and sediment control regulations.
  1. Compliance with the Warren County Subdivision Regulations, as applicable.
  1. Relocate proposed green space from northeast portion of site to west side, maintaining 10 feet buffer on the east and 21.6% green space overall.

CASE  #2006-399                  9847 Kings Automall Drive, Performance Lexus, Stage 2 Site Plan Review       

Staff Report                         Hayfaa Wadih explained the location of the proposed Lexus Showroom and building facility to be constructed on the 10.16 acre lot.  She said they propose 635 parking spaces and explained the lighting.  Ms. Wadih said the staff recommended approval including 19 conditions.  She gave all the details about this proposal and asked for board questions.  There were none.  Mr. Richardson asked the applicant to come forward.

Proponent                             Tom Vanden Bosch, McGill Smith Punsheon, 5700 Park 42 Drive, Cinti., 45241, said they are proposing a slight modification to this project, also.  They submitted a plan for a carwash inside the building and now have decided they want the carwash to be in a separate 2500 square feet building.  He showed a proposed location.  Terry Brennan, President of Brennan Builders, showed the location on the drawing for the proposed carwash building.  John Richardson asked if accessory buildings are allowed.  Lois McKnight said this is a PUD.  Mr. Richardson asked if there are any documents in the PUD which say there can’t be accessory structures.  Ms. McKnight said she didn’t know but because they are doing a revised preliminary Stage 2 for this site this board has the ability to approve it on this site if they wish.  Matt Evans asked if there are any accessory structures in the PUD?   Dan Hendy said this board had the authority to amend the PUD by this Stage 2 submittal and make that decision and it would be back in front of the trustees.  Robert Reichert, 9500 Kings Automall Drive, explained that right next door there is Kings Mazda in the front and a body shop in the back.  They are in the same PUD. 

Mr. Brennan said there is a pond planned and the Lexus cars would be displayed near the pond.  They plan to build a 1288 linear feet wall near the pond.  Mr. Brennan said they may use grass pavers as a surface for the cars.  John Richardson asked the board for questions.  Scott Evans asked where the cars would be unloaded.  Mr. Brennan said they have a designated area for that and they will not be doing the unloading on any roadway.  Matt Evans asked about something on the plan which said “future building” and he asked if this board could be approving something not shown.  Mr. Brennan said no building is proposed there.  John Richardson asked for more comments or questions.  There was discussion during the motion from Matt Evans to incorporate the changes on the site plan as discussed with the applicant.

No freeway-oriented pylon signage shall be permitted. Building mounted sign shall be no higher than the wall on which it is erected with a cumulative sign face area of 150 square feet.

11      Final detailed landscaping plan is required for Stage 3 submittal that shows bufferyard and landscaping including species and size, in compliance with Chapter 21 of Deerfield Township Zoning Resolution. Old Business                         There was discussion concerning the next regularly scheduled meeting on October 9th.  Since that is a federal holiday, the board decided to have our next Zoning Commission Meeting on Monday, October 16th.
