called the meeting to order.

present. Brian Leary and Mike Kean were absent with notice. Also present was
Deerfield Township Attorney, Dan Hendy.

Dan Hendy recommended this
case be tabled due to the absence of the proponent, Steve Waldmann. The motion
was approved to table the case. Mr. Waldmann came in late. At that time Greg
Porta made a motion to re-open Case 2007-025. There was a second by James
Rinehart. Vote was all yes.
Old
Business
Jim Rinehart asked about the sign being lit after hours at the Ace Hardware.
Greg Porta said he had noticed this at the last BZA meeting. Hayfaa Wadih said
that the Code Enforcement Officer doesn’t normally work the late hours which the
sign would be on. Lois McKnight told the board that the situation had not been
reviewed. Greg Porta said he would be willing to check it out after hours. Mr.
Porta expressed concern that this was specifically mentioned at the public
hearing and may have been included in the conditions. Lois said she wasn’t sure
if it had been included in the conditions for that case but she would review the
conditions.
Jim Rinehart asked if
anyone had looked at the situation of those cars with large advertising signs on
them being parked along Fields-Ertel Shopping Center.
Lois said she would make a note to have that checked out. Township attorney,
Daniel Hendy, administered the oath to those giving testimony.
CASE
2007-025 5620 Columbia Road,
Kings Local School District, Request for approval to build a storage building
similar to the existing maintenance building.
Staff
Report
Hayfaa Wadih explained the request for a storage facility for athletic
equipment. She pointed out on the school property the location of several sheds
and building and where they wanted to put the proposed building.
Ms. Wadih said on January 31st the staff along with a Warren
County Soil & Water Conservation Engineers visited the site. They inspected the
storm water management concerns expressed by an adjoining property owner. The
engineers found that the storm water management could be improved with a few
modifications to the site. It was apparent that the water problem mentioned by
the adjoining residents was not caused by run off from the parking area but
rather from the tennis courts. The storm water management could be improved
with a few modifications to the site such as a catch basin and detention pond
near the tennis courts. The Warren County Soil & Water Conservation Engineers
expressed their readiness to offer any advice to the school if they wish to
contact them.
Mr. Klatte inquired about the location of the future proposed concession
structure. Ms. Wadih showed it on the plan and noted that it is not part of the
case but rather for the future. Mr. Klatte closed this portion of the meeting
and asked the applicant to come forward.
Proponent
Steve Waldmann, 5620 Columbia
Road, Kings Schools, distributed
photos and showed the location of the building which would be 25 feet from the
existing building south of the tennis courts.
Mr. Klatte inquired about the construction of the proposed building.
Mr. Waldmann clarified that the building would be built by Blitz Builders and it
would be similar to the building which they built 2 years ago north to the
football field. It will be erected on a concrete slab.
Greg Porta asked the reason for
the location of the building. Mr. Waldmann explained that they plan to store
track items in the building. Greg Porta asked if Mr. Waldmann had discussed the
storm water run-off with the county staff. Mr. Waldmann said no, he hadn’t
discussed the storm water management with anyone.
Mr. Klatte asked about the time frame for the proposed concession
stand. Mr. Waldmann said the concession stand was in the original plan and due
to the financial situation, he doesn’t believe that is in the immediate future.
He said this proposed building is not part of the bond issue.
Mr. Rinehart said he didn’t have any photo to view of the building. Mr.
Waldmann said it would be exactly like the previously built one. Dan Hendy
asked Mr. Waldmann if he would give the township staff a photo of the building
for the file. Mr. Waldmann said he would.
Mr. Klatte asked if there would be gutters and downspouts on the
building. Mr. Waldmann said the first building does have gutters and this would
be the same.
Dan Hendy said this is a conditional use application and the board
should feel free to put conditions on the case. Dan Hendy said the applicant
should speak to how this would adversely affect the adjoining properties. Mr.
Waldmann said there is a tree line that makes a natural barrier between the
proposed building and the neighborhood so he didn’t believe there would be any
adverse affect to the neighbors. Mr. Klatte asked any concerned citizens who
wanted to talk to come forward.
Concerned Citizens Mike
Brown, 1956 Riverwood Trail, Kings
Mills, OH 45034,
said he was not opposed to any buildings or site improvements relating to the
school. He pointed out on the map the location of a 48 inch culvert pipe which
goes from his yard to a culvert in the neighborhood. He showed the location of
3 catch basins at the parking lot which drain down to an open ditch and then to
his pipe. Mr. Brown said he has about a foot of water running between the
houses. He said he was not earlier there to complain about the existing
situation. He was concerned about the future development as the school adds
hard surfaces. Mr. Brown expressed the need to plan for management of the storm
water.
Eric Reis, 1936 Riverwood Trail, Kings Mills, OH
45034, told Hayfaa Wadih that he
appreciated her efforts and he also appreciated that she took Warren County
Staff out to the site. He said he did not come to this meeting to prevent the
school from building their building. He said his primary concern is the storm
water. Also, he would like to request that they do not remove the tree line.
Chad Hanson, 1946 Riverwood Trail, Kings Mills,
OH 45034, projected a drawing on
the wall showing the French
drain in his back yard and a rock drainage
system. He said it works pretty well but in the spring there is a lot of
water. He
stated that he was not at
the meeting to try and stop them from building it but wanted them to take into
account the storm water issue.
Mr. Klatte closed this segment of the meeting
and asked for board comments.
Board Discussion
William Heckman asked Hayfaa to repeat what the
Warren County Soil & Water person said about correcting the water problem.
Hayfaa explained that the parking lot water drainage is on a hill and the water
goes down to the neighborhood. That situation could be improved by a catch
basin. The water coming from the tennis court has no catch basin either. They
thought a small retention pond would help that water situation. No trees would
be removed. The board had a question for the proponent.
Jim Rinehart asked if the school would be
receptive to adding a catch basin. Steve Waldmann,
5620 Columbia Road,
Kings Schools, said he didn’t know if the school would be willing to do that since this
proposed building is privately funded.
William Heckman said maybe this board should make a condition that the water
situation be addressed.
Greg Porta said there should be a condition that
gutters be put on the building. They will be adding more hard surface. Mr.
Porta said with that recommendation, the concern was where would that water go.
Ms. Wadih again explained thesite and she said Warren
County said at this point there may not be a problem but with future issues,
water must be
addressed.
William Heckman asked Dan
Hendy if the board could put in a condition regarding the drainage. Dan Hendy
stated that this is a conditional use case and that the board members are
looking at this development as a whole. As development continues to occur it is
within the board jurisdiction to do something about any adverse impacts on the
water issues.
Motion
Motion by
Greg Porta to approve Case 2007-025 with four
conditions as follows:
1.
Building must be constructed with
gutters around the eaves;
2.
Future requests for development of
school property shall be accompanied with an updated stormwater management plan
to mitigate the existing conditions;
3.
No trees shall be removed with the
construction of this building;
4.
Final plans must be approved by
Deerfield Township Community Development Department.
