                 BOARD OF ZONING APPEALS

            AGENDA

 

ROLL CALL:                          James Rinehart, Cherry Linder, William Heckman,  James Klatte, and Alternate Mike Kean  were present.  Brian Leary was absent with notice.

                                                Also present was township attorney, Andrew Gleason.

 

CALL TO ORDER:                                                                            

Minutes                                  Motion by James Klatte  to approve minutes of 06/09/2005.  There was a

                                                2nd by _William Heckman.

 

Roll Call:  James Klatte-Yes, James Rinehart-Yes Cherry Linde-Yes, Mike Kean-Yes, William Heckman-Yes  The motion was approved.

 

Andrew Gleason                   Administered the oath to those giving testimony.

 

CASE 2005-366                      Variance to construct a pool in the side yard @ 2537 Western Row Road

Staff Presentation                   Lois McKnight described the property and location.  She showed photos of the area where the proposed pool was to be installed.  She said some of the evergreen trees near the pond must be removed when the pool goes in.  Cherry Linder asked which trees would be removed.  Lois said when the applicant comes forward they could better explain which trees.  The plan is for a patio and spa near the pool.  Lois said if the board approves this case the staff recommends two conditions as follows:

 

1).        The owner and the applicant shall work with the staff regarding relocation of the trees, if required new

            pine trees shall be planted in compliance with the Deerfield Township Zoning Resolution, count of

            which shall not exceed the number of trees removed.

 

2).        The location of the pool and SPA shall be modified, if required, to avoid any negative impact on the

            existing pond.  A letter of approval from Warren County Engineer’s Office may be a required necessity

            of which shall be determined by the Deerfield Township staff.

 

Jim Klatte asked about the septic field and if this pool would affect that.  Ms. McKnight said the site plan shows the location of the septic field.

 

Proponent                             John Remke, Klimat Master Pools, 2440 Alexandria Pike, Highland Heights, KY 40176,  said that the septic system would not be affected by the construction of the pool because of the location.  Mr. Remke pointed out 2 pine trees and a dead tree.  He said possibly 3 or 4 trees must be removed.  Jim Rinehart said the staff report said possibly ten mature pine trees may be removed.  David Klein, 2533 Western Row Road,  came forward and pointed out the 3 or 4 trees which may be removed.  Jim Klatte asked if there would be a fence.  John Remke, Klimat Master Pools, pointed out where the 4 feet fence would

be located and he said there would be self latching gates.

 

Public Comments                Cherry Linder asked Mr Gleason if everyone in the audience had been sworn in.  They had not so Mr. Gleason did that. 

 

Roger Dick, 2531 Western Row Road, Maineville, OH,  wanted to verify what was the correct address of the property in question.  He asked if an alternate septic field would be required.  Ms. Linder said that Warren County (Health Department) must address that.

 

David Klein, 2533 Western Row Road, verified that 2533 Western Row was his correct address.  Cherry Linder closed the public portion of the meeting.

 

Discussion/Recommendation Ms. Linder said the fact that this pool would not affect the neighbors and she did not see a problem with it.  Mr. Rinehart asked if we should put in the resolution that there must be a fence. 

 

Mr. Gleason said we could do it either way.  Mr. Gleason said that Warren County would make sure there is a fence requirement when they give the permit.

 

Motion                                   Motion  by James Rinehart to approve Case 2005-366 including the Staff

                                                Condition #2.  There was a 2nd by James Klatte.
